Terms of use

These Terms of Use (“Terms”) govern your access to and use of thequantumclub.com (the “site”), operated by The Quantum Club B.V. (“The Quantum Club”, “we”, “us”, “our”), an invitation-only executive members club and talent partner registered in Amsterdam, the Netherlands.

By using the site you confirm that you are at least 18 years old and — where you act for an organisation — that you have authority to accept these Terms on its behalf. If you do not agree, please do not use the site.

These Terms cover your use of this website and your pre-contractual dealings with us — browsing, requesting an invitation, and partner enquiries.

They do not govern the member product or the commercial relationship. Membership of the club and its platform (“ClubOS”) are governed by the ClubOS Terms of Service, and hiring engagements for partner companies are governed by our Master Service Agreement and Data Processing Agreement. Those documents live at os.thequantumclub.com/legal, are the operative agreements, and prevail over these website Terms to the extent of any conflict.

Membership is by invitation and private review only. Requesting an invitation, applying, or making a partner enquiry through the site creates no entitlement to membership, a response, or any particular outcome, and no contract until we confirm one in writing.

Information you submit must be accurate and your own to share. For members, membership is offered at no monetary cost — you are never charged a fee by us, and any compensation you receive from a role is entirely yours.

For partner companies we place talent on a No Cure, No Pay basis: a success fee (standardly 20% of first-year salary, invoiced after the hire's start date) becomes due only once a candidate we introduce is hired, with a 60-day replacement guarantee. Introductions are confidential and provided for the relevant mandate only; hiring an introduced candidate outside our fee (“circumvention”) entitles us to the full fee.

This is a summary for orientation. The operative terms — fees, exclusivity, timing, payment, and guarantees — are set out in the ClubOS Terms of Service and your signed engagement, which prevail over this summary.

Discretion is central to how we operate. Information exchanged with us — identities, openings, introductions, and terms — is confidential and may not be disclosed without consent, except as required by law. You agree not to identify, approach, or solicit members, candidates, or partners you encounter through us outside the intended context. The operative confidentiality obligations for a mandate are those of your engagement and the ClubOS Terms.

Use the site only for lawful purposes. You must not disrupt, probe, scan, scrape, data-mine, reverse-engineer, or attempt unauthorised access to the site or its systems; introduce malicious code; misrepresent your identity; or submit false or unlawful information. We may investigate suspected breaches and withdraw access.

Your use of the member platform is additionally governed by the ClubOS Acceptable Use Policy at os.thequantumclub.com/legal/acceptable-use.

The Quantum Club name, marks, wordmark, monogram, site design, text, graphics, and content are owned by or licensed to us and protected by intellectual-property law. Except as expressly permitted, you may not copy, reproduce, modify, distribute, or create derivative works without our prior written permission. Member, partner, and case-study logos are used with permission and remain their owners' property.

How this website handles your data is set out in our Privacy Policy. Personal data processed through the member product, and cookies and AI transparency, are covered by the ClubOS Privacy Policy, Cookie Policy, and AI Transparency Policy at os.thequantumclub.com/legal. We process personal data in accordance with the EU GDPR.

The site links to our sibling properties — the member product (os.thequantumclub.com), documentation (docs.thequantumclub.com), and trust centre (trust.thequantumclub.com) — and to third-party services. Each has its own terms and privacy policies that govern your use of it; we are not responsible for third-party content or practices.

The site and any non-contractual materials, tools, and content are provided “as is” and “as available”, without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the site will be uninterrupted, error-free, or secure, and we do not guarantee any particular outcome, placement, or introduction.

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential loss arising from your use of this website. Our total aggregate liability arising from your use of the site is limited to one hundred euros (€100).

This cap applies to your use of the website only. Liability arising from membership or a hiring engagement is governed instead by the ClubOS Terms of Service and your engagement — not by these website Terms. Nothing here excludes liability that cannot be excluded under Dutch law (including for fraud, gross negligence or wilful misconduct, or death or personal injury caused by negligence).

We may update these Terms from time to time. The current version is always the one published here, and material changes take effect on posting. Your continued use of the site after a change constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the Netherlands, and disputes about the website fall under the exclusive jurisdiction of the competent courts of Amsterdam — without prejudice to any mandatory consumer protections available where you live.

We would rather resolve any concern directly — please contact us first at experience@thequantumclub.com. EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

Disputes arising from membership or a hiring engagement follow the dispute-resolution provisions of the ClubOS Terms of Service and your engagement (good-faith negotiation, then mediation, and arbitration via the Netherlands Arbitration Institute), which take precedence for those matters.
